Installation Agreement & Liability Disclaimer

Effective Date: September 2025

By requesting a quote, soliciting services, or entering into a contract with CTC Lights LLC (“CTC Lights”), the Client acknowledges that they have read, understood, and accepted the following terms and conditions in full.
This Agreement applies to all CTC Lights clients, whether the service was initiated through the website, by phone, text, email, or in person.

1. Installation Services

1.1. Scope of Services
CTC Lights will provide holiday lighting installation services as described in the Client’s quote or agreement. Installation will utilize the Client’s existing electrical system and power outlets.

1.2. Scheduling
Installation and removal schedules are subject to change due to weather conditions, safety concerns, equipment availability, workload, or other unforeseen circumstances.
CTC Lights will make every reasonable effort to adhere to requested or estimated installation and removal dates but cannot guarantee specific times or days.

  • CTC Lights will communicate any significant scheduling adjustments as early as possible.

  • The Client understands that installation and removal dates are approximate and may shift to accommodate weather, workload, or safety factors.

  • CTC Lights generally aims to complete removals by mid-January, but exact timing may vary depending on scheduling, staffing, and weather conditions.

  • By engaging CTC Lights, the Client acknowledges that installation and removal timing may be rescheduled at CTC Lights’ discretion without penalty or refund.

1.3. Property Access
By engaging CTC Lights’ services, the Client grants CTC Lights and its personnel full access to the property at any time, day or night, seven days a week for installation, maintenance, or removal.
Gates, fences, and access points must be unlocked or otherwise accessible.

1.4. Site Conditions and Safety
The Client affirms that their property—including roof, gutters, fascia, siding, and surrounding areas—is in safe and structurally sound condition for installation and removal activities.

  • CTC Lights is not responsible for damage caused by weak, aged, or improperly installed roofing, gutters, or structures.

  • The Client acknowledges that walking on roofs or gutters may be required and assumes all risks related to preexisting conditions.

1.5. Landscaping and Exterior Features
CTC Lights is not responsible for damage to landscaping, shrubs, trees, or outdoor décor that may occur as a result of normal installation, ladder placement, or removal.
The Client is responsible for identifying, marking, or protecting delicate landscaping or objects near the work area.

1.6. Fastening and Mounting Methods
CTC Lights may use any installation method, equipment, or materials it deems appropriate to safely and effectively install lights and decorations.
This may include, but is not limited to, staples, clips, adhesives, hooks, screws, anchors, proprietary fasteners, or other hardware specifically designed or adapted for CTC Lights’ process.

  • The Client grants permission for CTC Lights to use such methods on the property, including roofs, trim, fascia, siding, brick, stone, or other suitable mounting areas.

  • CTC Lights will make every reasonable effort to clean up and remove all fasteners and materials after removal but cannot guarantee that all items will be found or removed.

  • CTC Lights is not responsible for any damage, marks, holes, cracks, scratches, discoloration, or material failure that may occur from or relate to mounting, stapling, drilling, or removal.

  • CTC Lights is not liable for any injury, tire damage, or property damage caused by remaining staples, screws, clips, or other materials inadvertently left behind after removal.

  • The Client agrees to inspect the property following removal and promptly notify CTC Lights of any concerns.

  • The Client must notify CTC Lights before installation if certain surfaces cannot be stapled, drilled, fastened, or attached to (e.g., new paint, delicate finishes, or specialty materials).

1.7. Client Responsibilities
The Client agrees to provide safe and unobstructed access to the property, including clear driveways, walkways, and work areas.
The Client will ensure all power outlets are functional, accessible, and safe to use, and grants permission for CTC Lights to use them for the installation.
CTC Lights is not responsible for tripped breakers, blown fuses, or electrical issues caused by existing wiring or overloaded circuits.
CTC Lights is also not responsible for any damage to driveways, curbs, or landscaping caused by standard vehicle access or equipment placement required to perform the installation safely.

2. Timers & Service Calls

2.1. Timers
CTC Lights typically installs mechanical timers for lighting control.
In the event of a power outage or timer malfunction, the Client is responsible for resetting the timer.

2.2. Service Requests & Charges
If the Client experiences an issue and requests assistance, CTC Lights is happy to help.

  • Many issues can be resolved remotely via text, email, or phone at no cost.

  • If a service crew is dispatched to the property, a standard service call fee will apply unless the issue is determined to be a result of installation error under warranty.

3. Warranty

CTC Lights provides a limited installation warranty valid during the current holiday season (November 1 – January 31).

  • The warranty covers workmanship and installation defects only.

  • It does not cover damage caused by weather, animals, electrical issues, power surges, tampering, or third parties.

  • Any issues or concerns must be reported promptly for evaluation.

  • CTC Lights will make reasonable efforts to schedule warranty service or repairs as soon as possible; however, all warranty work is subject to weather, safety conditions, crew availability, and workload.

  • The Client understands that repair or service dates may be rescheduled or delayed due to these factors.

  • Repairs or adjustments under warranty do not extend the original warranty period.

4. Ownership of Materials

All lights, clips, cords, and decorations installed become the property of the Client upon completion and full payment.
Once ownership transfers, CTC Lights is not responsible for storage, maintenance, or replacement of materials after removal unless otherwise agreed in writing.
CTC Lights is not responsible for loss or damage due to weather, pets, vandalism, theft, or misuse.

5. Payment Terms

5.1. Down Payment
A non-refundable deposit is required to schedule installation.

5.2. Final Payment
The remaining balance is due within 30 days of the invoice date.
Late payments will incur a $50 per day fee.

5.3. Payment Authorization
If a card or payment method is provided, the Client authorizes CTC Lights to charge any remaining balance when due.

5.4. Deposit Policy
All deposits are non-refundable.
Cancellations after installation begins require full payment.

6. Marketing, Photography, and Property Use

6.1. Marketing Communications Consent
By requesting a quote, contracting with, or soliciting services from CTC Lights, the Client grants permission for CTC Lights LLC to contact them via phone, text, email, or mail for installation updates, scheduling, maintenance reminders, seasonal promotions, or future offers.
The Client may opt out at any time by replying “STOP” or unsubscribing from emails.
This consent complies with the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.

6.2. Photography and Property Access for Marketing
The Client authorizes CTC Lights to take photos and videos of the property and installation at any time, including after completion, without prior notice, for use in marketing, advertising, or promotional purposes.
CTC Lights will not share personal identifying information such as names, faces, or addresses.

6.3. Yard Signs and Marketing Materials
CTC Lights may place temporary yard signs or marketing materials on the Client’s property during the holiday season and up to 14 days after removal.

  • Signs remain the property of CTC Lights and may not be discarded.

  • The Client may request removal, and CTC Lights will retrieve the sign promptly.

7. Liability and Damage Waiver

  • CTC Lights is not liable for pre-existing damage or wear to roofs, gutters, siding, paint, landscaping, or electrical systems.

  • Minor scuffs, clip marks, or holes are considered normal results of installation and removal.

  • CTC Lights is not responsible for weather-related damage to lights, decorations, or property after installation.

  • The Client is responsible for providing safe, grounded, and adequate electrical outlets.

  • CTC Lights is not staffed by licensed electricians and does not modify electrical systems.

  • CTC Lights is not responsible for damage caused by vehicles or equipment necessary for installation when reasonable care is used.

  • The Client agrees not to interfere with or direct installation crews during service for safety reasons.

  • In no event shall CTC Lights’ total liability exceed the amount paid for the specific installation service giving rise to the claim.

8. Indemnification

The Client agrees to indemnify and hold harmless CTC Lights, its owners, employees, and subcontractors from any claims, damages, or losses arising from:

  • Use of the Client’s property or electrical system;

  • Failure of property structures or materials;

  • Interference by the Client, guests, or pets;

  • Acts of nature or other uncontrollable events.

9. Force Majeure

CTC Lights shall not be held liable for delays or failure to perform due to weather, natural disasters, labor shortages, equipment failure, or other events beyond its control.

10. Modification of Terms

CTC Lights reserves the right to modify this Agreement or Disclaimer at any time without prior notice.

11. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to this Agreement or the services provided by CTC Lights, both parties agree to first attempt to resolve the matter through informal discussion and mediation.
If the dispute cannot be resolved through mediation, it shall be submitted to binding arbitration conducted in the county where CTC Lights LLC operates, in accordance with the rules of the American Arbitration Association or a mutually agreed-upon arbitrator.
Each party shall bear its own costs and attorney’s fees. Any arbitration award may be entered as a judgment in a court of competent jurisdiction.

12. Governing Law

This Agreement is governed by and construed under the laws of the State of Washington.
In any dispute, both parties agree to jurisdiction within the county where CTC Lights LLC operates.

13. Severability

If any portion of this Agreement is found invalid or unenforceable, the remainder shall remain in full effect.

14. Acknowledgment

By requesting a quote, soliciting services, or entering into a contract with CTC Lights, the Client acknowledges that they have read, understood, and agreed to all terms in this Installation Agreement & Liability Disclaimer.
